A car is a sweepstakes prize that will attract a lot of attention to your promotion. However, there are a few more steps involved in giving away car sweepstakes prizes, as opposed to smaller sweepstakes prizes (namely, those valued at $600 or less).

Generally, we recommend hiring a sweepstakes company to manage a car giveaways sweepstakes. This will remove a lot of the hassle when it comes to managing a car sweepstakes and making sure that you’re covered legally.

To help you get started, here is what you need to know to give away a car as a prize.

Registration and Bonding

In several states, namely New York, Florida, and Rhode Island, registration and bonding are required for sweepstakes with high value prizes. The sweepstakes Sponsor must have possession of the car’s Title or Bill of Sale as proof of ownership for the state regulatory bodies and the surety bond issuing company.

Since the average new car is worth much more than $5,000, and if your sweepstakes will be offered to residents of any of these three states, you will need to follow the state laws for sweepstakes registration and bonding before your promotion goes live.

This is required in order for your “win a car” sweepstakes to be legal in those states.

Affidavit of Eligibility for Sweepstakes Winners

Asking a sweepstakes winner to sign an Affidavit of Eligibility and Publicity Release is important for promotions where the sweepstakes prize is a high-value item, such as a car. The affidavit of eligibility protects both the rights and responsibilities of the sweepstakes winner and the sweepstakes sponsors. 

It allows the sweepstakes winner to provide proof that they:

• Are eligible to win the automobile sweepstakes prize
• Have complied with the official rules when they entered
• Aren’t associated with the sweepstakes sponsors or sweepstakes administration company
• Agree to the terms of claiming the prize

We recommend that you require the winner to submit the affidavit of eligibility in order to claim the car.

Set a Deadline to Claim the Prize

For a car sweepstakes, it’s especially important for you to set a deadline to claim the prize because you want to make sure that you can locate the winner and award the prize quickly.

New cars depreciate in value fast, so we recommend that you set a deadline of no more than 30 days to claim the sweepstakes prize. Make sure to include in the Official Rules that the winner will forfeit the prize if it’s not claimed by the deadline.

Require a Driver’s License and Proof of Insurance on Delivery

Sweepstakes winners should submit their affidavit of eligibility before the Prize is awarded to confirm the winner meets the eligibility requirements. Additionally, you should also require them to have already obtained a valid U.S. driver’s license.

The car giveaways winner should also be able to provide proof of vehicle insurance (Comprehensive or Liability) at time of delivery, if required by law and requested by Sponsor or Administrator, or their authorized agent.

Once all of this information has been provided and verified by the sweepstakes administrators, then the sweepstakes sponsors can sign the car title over to the sweepstakes winner.

If you plan to run a Quebec sweepstakes, you may have noticed that many brands that run promotions in Canada exclude Quebec residents from entering due to sweepstakes rules Quebec. Nearly a third of Canadian citizens live in Quebec so there is a powerful incentive to include them in sweepstakes promotions. However, Quebec sweepstakes rules can make things more complicated.

As a Sweepstakes Company, here is what you should know about sweepstakes rules for Quebec, Canada in light of the recent changes.

As of 10/27/23 any sweepstakes offered in Canada and Quebec can be offered to all of Canada or all of Quebec or both without requiring bonding and registration in Quebec. Sweepstakes offered to Quebec are no longer required to be registered with Quebec.

RACJ Quebec

Sponsors who run Quebec sweepstakes are required to follow the sweepstakes laws set forth by the Regie des alcools, des courses et des jeux (RACJ). These laws are designed to protect consumers from scams and ensure that sweepstakes sponsors deliver prizes as promised. However, these consumer protections laws are expensive for brands to follow and the penalties are steep if they run afoul of the laws.

Fortunately, changes have been made to QC sweepstakes laws to remove the registration requirement if the promotion involves residents outside of Quebec, namely:

No Registration Required for International Promotions

Registration with the RACJ is no longer required for promotions that are International (open to Canadian residents and residents of any country outside of Canada). This applies only in the case where the promotion has no specific prize to be won only by Canadian residents, thus eliminating the requirement to register. The reasoning behind this change is that the prizes can be won by anyone who is eligible to enter, not just Quebec residents.

If Sweepstakes Prizes Are Allocated by Region, Registration With the RACJ Is Still Required

Opening a promotion up to residents of other territories outside of Quebec does not completely eliminate the requirement for registration. If the sweepstakes prizes are allocated by region, namely that an entrant from Quebec is guaranteed to win a prize, you must still register with the RACJ.

The sponsors of the promotion must register their official rules for the promotion and all advertisements with the RACJ prior to the launch of the promotion. The registration process requires a payment of duty. The payment of the duty varies based on the value of your prize, namely:

• If the aggregate prize value is over $100 but less than $1,000 CAD, 10% of the prize value must be paid and the promotion must be registered 5 days prior to the launch.
• If the prize is valued at $1,000.01 to $4,999.99 CAD, 10% of the prize value must be paid and the promotion must be registered within 30 days prior to the launch.
• If the value of any single prize in the promotion is greater than $5,000 CAD or if the aggregate prize value is $20,000 CAD or more, the promotion must be both registered and bonded with a fee of 10% of the prize value and the registration submitted 30 days prior to the start of the promotion.

The sweepstakes rules Quebec must also be publicly published at least 10 days prior to the start of the promotion.

Sweepstakes Official Rules for Quebec

Here is what sweepstakes official rules for Quebec must contain:

• French Translation. Sweepstakes rules must be translated into French in order to comply with Quebec’s Charter of the French language.
• Changes. The sweepstakes rules must also mention that the government of Quebec is permitted to make changes or cancel the giveaway as necessary once it is underway.
• Winner Test. Your sweepstakes rules should mention that the prize won’t be awarded until the winner correctly answers a skill-testing question. Typically, brands use a four-step math question.
• Winner Report. The sponsors of the sweepstakes must make a written report within 60 days of the end of the promotion to attest that they have delivered or tried to deliver the prizes to each winner with the inclusion of the winner’s name and address for prizes worth $100 CAD or more.
• Dispute Disclaimer. Sponsors are required to disclose that the government of Quebec may mediate any lawsuits arising from the sweepstakes promotion.

Next Steps

To summarize the recent RACJ changes:

• If a promotion is open to Quebec and other territories (such as the U.S.) and entrants from all territories are eligible to win all of the sweepstakes prizes, registration is NOT required. In other words, prizes can be won by anyone from any country who is eligible to enter.
• If a promotion is open to Quebec and other territories (such as the U.S.) and the sweepstakes prizes are allocated by region, (i.e. one prize awarded to a Canadian resident; one prize awarded to a U.S. resident) registration IS required.

Because these laws are significantly different from other Canadian province sweepstakes laws, as well as those of the United States, many brands typically void their promotions in Quebec. Three states require sweepstakes registration and bonding in order to run a promotion in those states. If your sweepstakes meets certain criteria, you must register and bond to make your sweepstakes legal in New York, Florida, and Rhode Island.

New York

New York State requires companies to register a sweepstakes if the prize being given or the pool of all prizes combined away is worth more than $5,000 retail value. A surety bond must also be obtained for the amount of the prize value.

Make sure to register your sweepstakes at least 7 days prior to the sweepstakes start date. You must also submit a winners list to the State of New York within 90 days after your sweepstakes end date.

Florida

If your sweepstakes prize or all prizes combined has a total prize with an Approximate Retail Value (ARV) of $5,000 or more and the sweepstakes is open to residents of Florida, you must register your sweepstakes with the state.

You will be required to submit a copy of the Official Rules, obtain a surety bond, and open a trust account with the state to ensure that the prize money is available to the prize winner.

The state of Florida requires that you register and bond your sweepstakes at least 7 days prior to the start date of your promotion. After your sweepstakes ends, you must also submit an official winners list to the state within 60 days.

Rhode Island

Rhode Island’s threshold for sweepstakes registration and bonding is lower than other states, namely for sweepstakes offered at retail establishments. If you plan to run an in-store sweepstakes promotion in Rhode Island, with prizes that are valued at $500 or more, you must register your sweepstakes with the state. This requirement only applies if the entrant must go to your brick and mortar location in order to enter the sweepstakes. In other words, the Sponsor must have a retail location in the state of RI for this requirement to apply.

Rhode Island does not require you to obtain a surety bond or file a winners list with the state. However, you must keep information identifying the winners of your contest for up to 6 months after the promotion’s end date.

Do Skills-based Contests Need Sweepstakes Registration and Bonding?

Contests in which the quality of the entries will be evaluated in order for a winner to be selected (e.g. photo contest or writing contest, games not based on chance) do not require bonding and registration in New York, Florida or Rhode Island.

However, if residents of the state of Arizona are allowed to participate, and a purchase is involved, registration and bonding is required for the state of Arizona.

Should you change the sweepstakes rules for your sweepstakes after it has started? Generally, no. However, you might think that you really need to.

Here is how to know when it’s okay to change your sweepstakes rules after the promotion starts and how to do it.

How Will the Sweepstakes Rules Change Affect Entrants?

The first thing you need to consider is how your sweepstakes rules change will affect existing entrants. In some instances, the change could have a major impact which would actually render your sweepstakes illegal.

If any of the following apply, do not change your sweepstakes rules:

• You’ve already registered and bonded your text sweepstakes. If your promotion is registered and bonded with the Attorney General in the states of New York or Florida.
• A change to the Official Rules changes the odds of winning. If your change affects the integrity of the sweepstakes, you could be fiend or plagued by negative PR by the entrants.
• Your sweepstakes rules changes create an unfair advantage. If earlier or later entrants have a better chance of winning because they are held to different standards than the other group, then don’t make changes to the rules.

These reasons are the main reasons for why you shouldn’t change your rules if you don’t want to cause your promotion to be deemed illegal, or not following sweepstakes laws or considered unfair by entrants. So if a rule change is still needed, in these cases, consult an attorney first.

How to Announce a Sweepstakes Rules Change

Now let’s say your sweepstakes rules change is actually allowed (because it does not meet the criteria above). If you’ve decided that you’d like to change the end date of the promotion, for example, make a formal announcement before the change goes into effect.

Include the announcement of the change in your updated Official Rules as an amendment. The revision, and the date that it goes into effect, should be clearly indicated in all of your sweepstakes advertising materials and Official Rules. Identify and date the rules changes using the phrase “effective as of.”

Make sure the sweepstakes rules change announcement is visible on all mediums where you have/will advertise your sweepstakes. For example, if you promote your sweepstakes via ads on social media, then you must also make an ad that announces the rules change.

Be Prepared for Questions

It’s inevitable that entrants will have questions about your sweepstakes changes. Be prepared for questions and negative feedback from entrants who aren’t happy with the change. Responding promptly and honestly is the best way to avoid major disruption to your promotion.

Given the potential for fallout and the loss of trust that a sweepstakes rules change may cause, the best thing to do is to just get it right from the beginning. However, if a sweepstakes rules change is unavoidable, make sure that you have a plan in place.

Anytime you run a sweepstakes, you must ensure that you comply with all relevant laws, regulations, and rules. In some cases, New York sweepstakes rules require that you take some additional steps, including registration and bonding.

Here is what you need to know about New York sweepstakes laws to ensure that you are putting together a regulation compliant sweepstakes.

Registration and Bonding

In some states, you are required to register and bond your sweepstakes before you launch it if the value of the prize exceeds a certain minimum. Florida and Rhode Island are the two other states besides New York that have such a requirement.

The game of chance (GOC) bond guarantees that the sponsor of your sweepstakes has the financial ability to deliver the prizes. The registration simply means that you must make the state aware of your promotion in writing.

When you run a sweepstakes in New York, if the total value of the prizes exceeds $5,000 you must register and bond your sweepstakes no later than 30 days prior to the start date of your sweepstakes. There is also a filing fee that must be paid.

How to Avoid Bonding and Registration in Florida and New York?

If you want to avoid these requirements you have two options.

1. You can either make sure that the total approximate retail value (ARV) of all prizes is less than $5,000
2. Or you can exclude Florida and New York State residents from participating in your sweepstakes. However, that may defeat the purpose of your promotion.

Even if you are not required to register and bond your sweepstakes, New York law requires that your sweepstakes rules include the minimum number and value of prizes to be won over a stated period of time and geographic location.

File a Certificate of of Deposit

Although not required, a company may decide to establish a special trust account at a financial institution to cover the total value of the prizes to be offered in the sweepstakes. Many large companies that regularly run New York sweepstakes promotions choose this option.

If you decide to estate a trust account, a copy of the certificate of deposit from the trust account must also be filed with the New York Department of State within 30 days of the start of the sweepstakes.

Submit a Certification of Winners Form Within 90 Days

Within 90 days of the completion of your sweepstakes, you must publish a listing of the names and addresses of each winner of every prize if the winner won a prize with an ARV of more than $25.

The listing must be filed with the New York Department of State and must include a description of the prize won, as well as, the date that the prize was awarded to the winner.

A New York regulation also requires that you include the address where anyone may obtain a copy of the winners’ list upon request (this can be a web page). You must retain a copy of this list and be able to share it with anyone upon request for six months after the sweepstakes has ended.
